U.S. Tax Code Bill Recognizes Preborn Babies

The U.S. House of Representatives recognized children in the womb with the passage of a tax reform bill that allows unborn children to qualify for education savings accounts.

This is “a big pro-life win,” said Andrew Guernsey, senior legislative assistant at the Family Research Council (FRC). “It gets the unborn recognized in the tax code.”

The same tax code that has been known for subsidizing abortions is now making a pro-life stance. Naturally, Planned Parenthood and NARAL are adamantly against the bill because they deem it an attack on a woman’s “reproductive rights.”

While the bill still needs to pass the Senate and be signed by the President before it becomes law, many conservative pro-lifers are encouraged by the change. “Anytime—and in any way—that our laws recognize the unborn as persons, it advances the cause to protect all unborn children,” said Greg Schleppenbach, associate director at the United States Conference of Catholic Bishops’ (USCCB’s) Secretariat of Pro-Life Activities.

Harvard Law Journal Highlights Constitutional Rights of the Unborn

Josh Craddock, writing in the student-run Harvard Journal of Law and Public Policy, asserts that the unborn are “persons” entitled to the Fourteenth Amendment’s equal protection clause. Therefore, he contends that Roe v. Wade must be overturned.

“Just as ‘freedom of speech’ protects movies and internet communication under an originalist interpretation even though those technologies did not exist at the time of the First Amendment’s adoption,” writes Craddock, “‘person’ protects every member of the human species, regardless of whether individuals were recognized as members of the human family at the time of the Fourteenth Amendment’s adoption.”

But he also makes the point that, at the time of the amendment’s adoption, “states widely recognized children in utero as ‘persons.’”

Passage of Amendment 1 Gives Voters Back Their Voice on Abortion Policy

FRANKLIN, Tenn. (November 4, 2014) – David Fowler, President of The Family Action Council of Tennessee (FACT), issued a statement in response to the passage of Amendment 1:

Today is a great victory for the people of Tennessee, who have reclaimed from our state Supreme Court their right to have a voice on abortion policy in our state. It is a victory for a government of and by and for the people, and a victory for the protection of women and their unborn.

We are proud of the people of Tennessee who rejected the deceptive media messages against Amendment 1 paid for by millions of dollars from abortion providers both inside and outside of our state. The passage of Amendment 1 shows that thousands of citizens coming together on something about which they are passionate can accomplish something that money alone can’t buy.

The Family Action Council of Tennessee, which Fowler heads, was formed in 2006 by a group of citizens concerned about the growing negative impact of public policies on the family.
