SUMMARY

Proposes new provision to Article I to provide that nothing in Constitution of Tennessee secures or protects right to abortion or requires the funding of an abortion; states that the people retain the right through their elected state representatives and state senators to enact, amend, or repeal statutes regarding abortion, including, but not limited to, circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the mother.

STATUS

Senate: Adopted by the Senate on 04/18/2011 and by the House on 05/20/2011. This resolution now moves to the ballot for public vote in 2014.

FACT’S ANALYSIS

This bill as amended would put on the ballot an amendment that, if approved by the people, would allow the legislature to pass certain laws regulating abortion that the U.S. Supreme Court says are constitutional but that Tennessee’s state Supreme Court says are not constitutional under Tennessee’s constitution.
