Last week, the U.S. Court of Appeals for the 6th Circuit upheld Kentucky’s ultrasound law. This is important given the Tennessee Legislature’s debate over the constitutionality of a fetal heartbeat abortion bill.
First, the court used the words “unborn child” or “unborn life” a total of 30 times in its opinion, a recognition that abortion takes the life of a child. But more importantly, it cited approvingly another circuit court decision affirming that abortion “terminate[s] the life of a whole, separate, unique, living human being.”
Given that this is the court to which any decision involving Tennessee’s heartbeat bill would be appealed, now is the time for Tennessee’s Legislature to assert an unborn human being’s right to life as one of the unenumerated but inalienable rights protected by the too-long forgotten Fifth and Ninth Amendments to our Constitution.
