All of us had biological parents. Some also had adoptive parents. Others had a step parent because their widowed or divorced biological parent married another person. But Tennessee is now being sued on the ground that this limited understanding of parentage is unconstitutional.
The plaintiff, a woman, is arguing that she is a child’s mother because she was married to the child’s biological mother at the time the child was conceived through sperm donation.
This, she says, is required because the U.S. Supreme Court requires the state to treat same-sex marriages the same as male-female marriages. Thus, if a man and woman are both parents to a child born during their marriage, then two women must both be parents to a child born during their marriage.
So, if you think same-sex marriage is just about marriage, think again.
