Tennessee Law License Revoked?

Christian lawyers could find themselves disbarred if Tennessee’s Supreme Court adopts a proposed change to the ethics rules that govern Tennessee’s attorneys.

The proposed change adds a commentary to illuminate the intent behind the rule prohibiting discrimination. The proposed change says it is unethical for lawyers in either their professional or personal lives to “discriminate” on the basis of sexual orientation, gender identity, or marital status.

But to advocate against same-sex “marriage” and the cultural acceptance of homosexuality is not discriminatory to the Christian who believes that those things pervert God’s creational design for humanity.

Of course, others would disagree, and that points to the problem the professional organizations advocating for this change have: They have not provided a standard upon which certain actions can be deemed discriminatory. And with the absolute God who provides that standard, they cannot.

Are Inalienable Rights Dead?

Our recent focus on taking back marriage from the Supreme Court raises an even larger question: Does the right to marry come only from a legislative statute or a judicial ruling?

If it does, then inalienable rights may be dead. The whole premise behind them is that they do not come from a “law” that civil government makes, but from our Creator. But if we no longer believe marriage is rooted in the pre-existing creation law of God, then on what ground can we assert a right to life, free speech, or religious liberty? After all, civil governments have forbidden those rights in the past, but never the right to marry.

If Christians won’t fight for the right of a man and woman to marry without a government license, then maybe we don’t believe in inalienable rights anymore.

Getting Back to a ‘Real’ Right to Marry

After the Supreme Court’s ruling in 2015, many Christians lost hope that God’s design for marriage would ever be restored. And it won’t be for a long time if we continue to argue that the right to marry and the definition of marriage comes from a government statute.

However, the U.S. Supreme Court has recognized that a man and woman have a right, under the common law, to marry; it was a right not “conferred” by the government but pre-existed government.

To restore marriage, states must get out of the business of “creating” marriage by statute and allow a man and woman to exercise their God-given right to marry and file a public notice evidencing, not creating, their marriage. This has the potential to take marriage back out of the government’s hands.

The Constitutional Abolition of Parental Rights

Historically, parental rights were grounded in biological kinship ties. Certain rights to the nurture and care of children were said to arise naturally out of that biological relationship, and therefore civil government had to respect those pre-existing rights.

But in 2015, the United States Supreme Court severely undermined that kind of argument. The Court said biological sex, as a matter of constitutional principle, was irrelevant to marriage.

But that also makes it irrelevant to the other legal issues that flow out of marriage, such as parenthood.

Now some legal scholars are saying that parenthood must be based on the functions a person performs and then the status of parent bestowed on those who carry out those functions.

But when government, not biology, controls who is a parent, parental rights as a real thing no longer exist.
