FACT Report: Redefining Words, Rewriting Laws

Soon the Tennessee Senate will vote on a bill telling courts that any undefined word in the Tennessee Code should be given its normal and ordinary meaning. The bill is needed because judges increasingly like to give otherwise unambiguous words new meanings, essentially rewriting statutes to suit their policy agenda.

Unfortunately, our attorney general just gave our black-robed legislators ammunition for doing so. When gay rights advocates in the Legislature asked how the new bill would apply to words like “father” and “husband” in our statutes, he issued an opinion saying that courts can give those words a gender-neutral meaning like “parent” and “spouse.”

Two years ago, the U.S. Supreme Court redefined marriage. It looks like our attorney general now wants courts to rewrite the other words associated with the family to comply with the gay agenda.

FACT Report: Legislative Showdown With the Attorney General

Two weeks ago, a state judge ruled that he could rewrite a statute expressly governing a husband and a wife so that it applied to a wife and a wife.

A number of Tennessee legislators were hopping mad, but particularly with the attorney general. He had helped convince the judge that the U.S. Supreme Court’s same-sex “marriage” decision now requires judges to rewrite the state’s family law statutes in a way that makes the words “husband” and “wife” interchangeable.

Judges increasingly hold good laws unconstitutional, but now the attorney general is arguing that they can just rewrite them instead of striking them down.

A number of legislators are growing increasingly tired of being represented by an attorney general who does not respect the legislative branch. Look for a showdown next session between the Legislature and the attorney general.

FACT Report: The ‘Little Guys’ Rise Up in the House

The Tennessee House has always operated with a top-down management style with the Speakers seemingly always loyal to their party’s Governor. As a result, rank-and-file Representatives can represent their constituents so long as their views don’t conflict with those of the Speaker or Governor.

But a few years ago, the “Little Guys” in the House fought the Speaker and Governor on Common Core and got some changes made. Now the same thing is happening on the Governor’s gas tax proposal. The “Little Guys” are protesting the way the proposal has been rammed through some House committees.

As citizens, we often feel like we don’t have much say in what happens, either. So, regardless of how our legislators decide to pay for our roads, it’s nice to see the “Little Guys” rise up and demand to be heard.

FACT Report: What Servant Leadership Requires

Recently, leaders in the Tennessee Senate made sure a senator had no opportunity to present her bill to protect the privacy of children in public school bathrooms and locker rooms.

Then leaders in a Tennessee House committee made sure opponents of the governor’s gas tax proposal didn’t get to speak.

The way some of our legislative leaders are acting is quite a contrast to what Jesus said should be true of leaders, “You know that those who are recognized as rulers of the Gentiles lord it over them . . . But it is not this way among you, but whoever wishes to become great among you shall be your servant” (Mark 10:42-43 NASB).

Servant leadership requires leaders to give up control and put their faith in God’s good providence, to trust Him with results. And that may just explain why servant leadership is so rare.
